North Dakota Mineral Owners Face Struggles With Oil Companies

In North Dakota's oil-rich Bakken region, mineral owners like Diana Skarphol have faced rising frustrations over deductions from their royalty checks by oil corporations. Diana’s family has received monthly payments for over 50 years based on their underground mineral rights. However, a shocking discovery in 2015 revealed that Hess Corp., the company behind their oil well, had deducted a staggering 35% from their expected earnings, leaving them bewildered and deprived of vital income.

Bob Skarphol, Diana's husband, who was also a state lawmaker, recalls the moment of confusion when Diana contacted him while he was en route home. “Why are there minuses?” she inquired about the deductions. This moment marked the beginning of their decade-long quest for clarity and justice.

Unfair Practices and State Inaction

The Skarphols are not isolated in their plight. According to a recent study from North Dakota State University, mineral owners are estimated to be owed $4.6 billion in royalties before various deductions. These deductions, which can swing dramatically from one month to the next, have sparked significant debate within the community. While the oil companies argue that various transportation costs should be shared with royalty owners, many owners argue that such deductions should not occur in most circumstances.

Despite the substantial amounts withheld, North Dakota's regulatory framework does not govern the deductions made from the royalty payments. There is currently no oversight or official accounting of how much money is withheld, leaving many feeling powerless against the corporate behemoths.

The Need for Legislative Oversight

The absence of regulatory action over the past decade has been a recurring frustration for mineral owners. Many, including the Skarphols, have reached out to state leaders for intervention. Yet, public officials have largely remained silent, a situation some attribute to the outsized influence of the oil industry on local politics.

The lack of accountability allows companies like Hess to withhold substantial portions of the earnings, leading to anger and confusion amongst mineral owners. Court documents and interviews with twenty mineral owners reveal a troubling trend: considerable deductions—sometimes exceeding 50%—are not just unfortunate anomalies, but rather a systemic issue faced by many.

Call for Transparency and Justice

This narrative of withholding royalties is a microcosm of larger issues surrounding energy extraction and local governance in North Dakota. The frustrations of mineral owners illuminate the need for transparency and proper oversight in the management of their rights versus corporate interests. The time for action is now, as both local residents and lawmakers must come together to advocate for fair practices that protect the rights of mineral owners.

The situation of the Skarphols and their fellow mineral owners serves as a rallying cry for change, emphasizing that the voices of those affected by these policies must be heard. It poses a crucial question: will the state be able to put the interests of its mineral owners first and ensure equitable practices in the oil and gas industry?
